1. GENERAL PROVISIONS
 
1.1. These Rules of Purchase and Sale of Goods (hereinafter the “Rules”) are a legal document binding on the parties, which establishes the rights and obligations of the Buyer and the Seller, conditions of purchase and payment for goods, delivery and return procedures, liability of the parties and other related provisions in the online store gudrutis.lt.
1.2. By placing an order, the Buyer confirms that he agrees with these Rules.
1.3. The Agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer has formed a shopping cart in the online store, indicated the delivery address, selected the payment method and read the Terms and Conditions, clicked the "Pay" button. 2. PROTECTION OF PERSONAL DATA 2.1. When ordering goods in the smiley.lt online store, the buyer must provide the data requested during the purchase: name, surname, address, telephone number and e-mail address. 2.2. The buyer is responsible for providing the correct data during registration. 2.3. By placing an order, the Buyer agrees that the personal data provided by him will be processed for the execution and purposes of the order. The Buyer also agrees that the e-mail specified by the Buyer information messages necessary to fulfill the order of the goods would be sent to the e-mail address. 2.4. Buyer’s personal data may be processed for marketing purposes.
 
3. PURCHASE RIGHTS AND OBLIGATIONS
 
3.1. The Buyer undertakes to pay the Seller the agreed amount for the ordered goods and to accept them.
3.2. Provide the correct information on the purchase form.
3.3. The Buyer has the right to withdraw from the contract of sale of goods in accordance with the provisions set forth in Paragraph 8 of these Rules.
3.4. By placing an order in the online store gudrutis.lt, the Buyer agrees with these Purchase and Sale Rules and undertakes them and the established legal acts of the Republic of Lithuania.

4. RIGHTS AND OBLIGATIONS OF THE SELLER
 
4.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the online store gudrutis.lt.
4.2. If the Buyer tries to damage the stability and security of the online store or violates its obligations, the Seller has the right to immediately and without notice restrict, suspend or revoke the Buyer's access to the online store.
4.3. The Seller undertakes to respect the Buyer's right to privacy of the personal information belonging to the Buyer specified in the purchase form and not to transfer it to third parties.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
4.5. The Seller may, in important circumstances, temporarily or permanently terminate the operation of the online store without notifying the Buyer in advance.
4.6. The Seller may unilaterally change the terms of these Rules.
 
5. ORDERING GOODS, PRICES, PAYMENT PROCEDURE, TERMS
 
5.1. In the online store, the Buyer can buy online 7 days a week, 24 hours a day. per day.
5.2. All product prices in the online store are in euros, including VAT.
5.3. The buyer can pay for the goods:
5.3.1. using your email banking system - the Buyer transfers the money to Opay.lt current accounts.
5.3.2. using the services of the payment intermediary www.Opay.lt.
5.3.3. cash upon arrival at the office - Klaipeda, Danes str. 25.

6. DELIVERY OF GOODS
 
6.1. The buyer undertakes to indicate the exact place of delivery of the goods.
6.2. The buyer undertakes to accept the goods himself. If the buyer's goods are defective, they cannot be delivered if the goods are delivered incorrectly.
6.3. Goods Omniva LT, LT Paštas, LPexpress, DPD or Autobusų šuntų services are delivered to the Buyer.
6.4. The goods are removed from the Buyer on the next business day from the confirmation of payment.
6.5. In Lithuania, goods are delivered within 1-3 working days.
6.6. In all cases, Sellers are free to deliver the goods and deliver the goods immediately after the fault of the Buyer has been changed by independent circumstances.
6.7. If the Buyer can provide information about the Seller, if he is not satisfied, he will have an unused product and an incomplete set of goods.
6.8. The buyer can e-mail present the dangerous packaging and / or goods (ies) provided to the Seller.
 
 
7. QUALITY OF GOODS, WARRANTY
 
7.1. All data of the goods sold in the smiley.lt online store are indicated next to each product, where there is a description of the goods.

7.6. When submitting the product for repair, you must present a document confirming the purchase of the product (invoice or money receipt).

8. RETURN AND EXCHANGE OF GOODS

8.1. The buyer must send the returned goods by registered mail. The registered shipment number must be provided to the Seller no later than within 24 hours. after dispatch.
8.2. The cost of returning returned quality or replaceable goods is paid by the buyer.
8.3. In order to return the product (s), the Buyer may do so within 14 (fourteen) days from the date of delivery of the goods to the Buyer.
8.4. After more than 14 (fourteen) days from the date of delivery of the goods, the Retail Trade Rules of the Republic of Lithuania shall apply to the return of the goods.
8.5. The returned product must be in the original tidy packaging, undamaged, unused, of the same set as the Buyer received it, without losing the appearance of the goods (undamaged labels, peeled off protective film, etc.). When returning the product, it is necessary to submit a paper (printed) document of its purchase (copy of the order, order).
8.6. When returning a quality product, only the amount of money paid for the product is returned to the Buyer. Shipping costs are not refundable to the buyer.
8.7. Upon returning the wrong product received, the Seller undertakes to replace such product with the required product. If you do not have the required goods, the Buyer will be refunded all money (for the goods, and the actual shipping costs incurred).
8.8. When a defective product is returned, the Seller undertakes to replace the defective product with a similar product or return the money to the Buyer.
8.9. In order to return the defective product (s), the Buyer may do so within 14 (fourteen) days from the date of delivery of the goods to the Buyer, informing the Seller by e-mail. by e-mail, attaching photos or videos of low-quality goods and / or parcels describing the problem, and filling in a special exchange-return form on the "Return of Goods" website.
8.10. The returned defective product must be in the original neat packaging, undamaged, unused, of the same equipment as the Buyer received it, without losing the appearance of the product (undamaged labels, unripped protective film, etc.). When returning the product, it is necessary to present a paper (printed) document of its purchase.
8.11. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not comply with the procedure for returning the goods set forth in clauses 8.3, 8.5.8.9-8.10 of these Rules.
8.12. If the Buyer has paid for the item with a gift voucher, the coupon and other additional amount paid (if it has been paid) will be returned.
8.13. If the Buyer returns the product purchased at a discount, the amount paid for the product with a valid discount is refunded.
 
9. MARKETING AND INFORMATION
 
9.1. The seller can organize various promotions and offers in the online store smiley.lt.
9.2. The seller has the right to unilaterally, without separate notice, change the terms of the shares, as well as cancel them. Any change or cancellation of the terms and conditions of the shares shall take effect from the moment of their change or cancellation. 9.3. The Seller sends notifications to the Buyer to the e-mail address specified in the Buyer's registration form.
9.4. The Buyer sends all notifications and questions to the Seller's e-mail. the contacts listed in the "Contacts" section of the store. 9.5. The Seller shall not be liable if the Buyer does not receive the sent information or confirmation messages due to internet connection, e-mail service provider network failures, messages falling into the SPAM (spam) category, or due to incorrect data provided by the Buyer.
 
 
10. FINAL PROVISIONS
 
10.1. These Rules of Purchase and Sale of Goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
10.2. The law of the Republic of Lithuania applies to these rules. All disputes arising out of the application of these rules shall be settled by negotiation. If no agreement is reached, disagreements are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
